About Writing a Will

- Why do I need a Will?

A Will is the only way to ensure your wishes will be honoured as you intend. Even if you already have a Will, a change in your circumstances may mean you need to update it, to ensure your loved ones are provided for.

Having spent a lifetime working to build a life for you and your loved ones, allowing your estate to be in dispute once you’ve gone is an unnecessary risk to take.

- What is a simple Will?

Broadly speaking, a Will for anyone whose assets are below the inheritance tax threshold and/or is simply leaving their assets to a few family and friends or charities would be considered a simple Will. 

If you require any trusts set up or financial or estate-planning advice, for example, then this would be considered outside our definition of a simple Will.

We would recommend that you discuss this with your chosen solicitor, who may charge you an additional fee for the extra work required in preparing your Will.

- What is a mirror Will?

Mirror Wills are a set of two near identical Wills. Its name derives from the distribution of a couple’s estate, which is usually the same, except for the initial stage. Each partner will gift their estate to the other in the event of their death, but the remainder of their Wills will be identical, naming the beneficiaries of the survivor’s estate and who they both wish to benefit from specific possessions or gifts.

About the Write a Will offer

- Why is the suggested donation £50 and £75?

The donation is a suggested amount, and is made at your discretion. The average cost of writing a Will varies throughout the country, but to write a Will with a solicitor would generally cost considerably more than £50. 

The solicitors participating in Write a Will for Tŷ Hafan are waiving their usual fee, helping us to raise vital funds to allow us to continue to support life-limited children and their families, whilst still providing you with a great offer. Therefore we encourage you to give generously, and to respect the value of the service being offered.

- How will my donation be spent?

Some examples of how your donation could make a difference to the life-limited children Tŷ Hafan supports: 

£50 could pay for one hour of music therapy in a family’s home, giving a life-limited child their first chance to be creative.

£75 could pay for three hours of specialist care at Tŷ Hafan’s hospice, giving Mum and Dad some precious time to spend with their other children, making sure they get the attention they often miss out on.

£100 could pay for four children to receive an hour each of physiotherapy, helping to ease the pain children and young people experience as a result of their conditions.

£150 could pay for a whole day of support for a family in their own home, giving the family the help they need to cope with the daily challenges they face.

- Why do I need to make a donation before making my appointment?

Some solicitors are able to offer only a restricted number of appointments during the Write a Will fortnight, so we need to ensure that these solicitors do not receive more requests for appointments than they can handle. Once a solicitor's quota has been reached, and they have filled all available appointments, they will be removed from our website. 

It also means that your appointment with the solicitor concentrates solely on preparing your Will, rather than on collecting and processing your donation – making a better use of their valuable time.

- How do I book my appointment with a solicitor?

To book your appointment with a solicitor, you must first complete the Write a Will donation form. At this point, you will also get to choose the solicitor that you wish to make an appointment with. As some solicitors only have a restricted number of appointment spaces they are able to allocate to us, we recommend that you do this sooner rather than later. 

Once you have completed the form, a voucher will be emailed to you – or posted – with the details of the solicitor you have chosen. You should then contact the solicitor at the earliest convenience to book an appointment between 26 February – 11 March 2018.

As the solicitor will also have been sent your details in advance, they will be expecting your call.

- What if my chosen solicitor cannot make an appointment in the Write a Will fortnight?

- I haven’t received my voucher. Who should I contact?

If you haven’t received your voucher, please contact us on legacy@tyhafan.org or call 029 2053 2255, and we will be able to send the voucher to you.

There isn’t a solicitor in my local area. 

We have tried to ensure that there are a number of solicitors in each area of Wales, but we understand that there may not be a solicitor in your home town. We are unable to guarantee that there is a solicitor in your local area, as it may be that we were unable to secure any support from solicitors here. 

Also, some solicitors are understandably only able to offer a restricted number of appointments for the Write a Will offer, so it may be that your local solicitor has already taken a number of appointments, meaning we have removed their details from our website.

- What is Gift Aid?

By completing the Gift Aid form, we can add a further 25% on top of your donation – providing you have paid more than this sum in tax during this financial year. If, for example, you are a taxpayer and donate £100 in a particular tax year, Tŷ Hafan can claim back £25 of Gift Aid from HMRC. This increases the value of your donation to £125.00.

About leaving a gift in your Will

- What type of gift can I leave in my Will?

The main types of gifts which can be included are the following:

Cash gift - a gift of a specific sum of money to Tŷ Hafan e.g. £100 or £100,000. No gift is too small or indeed too large!
Gift of an item - this is defined as a specific gift such as property, jewellery, shares, or a car.
Share of your estate - this is the remainder of your estate after all other gifts have been made and any expenses have been deducted. This can be all of your estate or a percentage.

You can speak to your solicitor about other types of gifts, for example, conditional gifts.

- Do I have enough to leave a gift?

Absolutely. We appreciate all gifts – large and small – and every pound received will make the lives of those who need our service a little bit brighter.

- Can I leave the contents of my house to Tŷ Hafan?

Yes, we are able to sell a variety of personal and household belongings in the Tŷ Hafan shops. If your belongings are particularly valuable, we may decide to sell them at auction to be sure they are sold for the best possible price. If you wish to leave some of your valuable belongings to Tŷ Hafan, it would be helpful if you could specifically mention these items in your Will.

- What will happen if my circumstances change?

If your circumstances change, and you feel you can now leave a larger or smaller gift to Ty Hafan, it may be necessary for you to draft a new Will. The new Will will supersede any previous versions. It is common for people to make numerous Wills in their lifetime, reflecting financial changes, different family commitments, property purchases, etc.

If – having included a gift in your Will to Tŷ Hafan – you change your mind, there is no obligation for you to include this gift if you write a new Will.

To avoid unnecessarily changing your Will, it could be beneficial to include a gift to Tŷ Hafan as a percentage of your overall estate. In this instance, if your estate is worth more, or less, at the time of your death, a gift can still be paid to all your chosen beneficiaries.

- What details do I need to include to ensure there is no confusion over where I want my gift to go?

- I would hope to live for a long time yet – how do I know you will need my gift in years to come?

We have more and more children and young people that need our care and support and we do not expect that this need will decrease. Also, as costs are continually increasing, we need to generate more and more income to continue to operate.
